New UK Vape Laws 2026: Vape Tax, Bans & Key Dates

UK vape law is changing in stages. The disposable ban is already in force, a new e-liquid duty begins in October 2026, and wider sales restrictions follow later that month. Other measures are planned or still under consultation.

Here is what is confirmed and what remains a proposal.

New UK Vape Laws: Key Dates

Here’s a quick glance at the timeline: 

The Tobacco and Vapes Act 2026 became law on 29 April, but its measures start on different dates.

Is the Disposable Vape Ban Already in Force?

Yes. Since 1 June 2025, businesses have been prohibited from selling or supplying single-use vapes online and in shops, with or without nicotine.

What Counts as a Reusable Vape?

A reusable vape needs a rechargeable battery and a refillable container. It can be refilled with bottled e-liquid or a new prefilled pod. Any coil must be replaceable, either separately or as part of the pod.

Rechargeable does not automatically mean reusable. Refills and replacement coils or pods must be sold separately. See the government’s single-use vape guidance for the full definition.

Why Are Disposable Vapes Still Being Discussed Online?

The photograph does not confirm what was being sold. The sign may be old, and some legal pod kits resemble disposables. It does reflect concern about enforcement.

Which UK Vape Rules Already Apply?

The existing product rules remain in place:

• Vape tanks and pods are limited to 2ml

• Nicotine-containing refill bottles are limited to 10ml

• Nicotine strength cannot exceed 20mg/ml

• Relevant products must meet notification, packaging and labelling rules

How Will Vaping Products Duty Work?

Vaping Products Duty starts on 1 October 2026. It will be charged at 22p per millilitre, or £2.20 per 10ml, regardless of nicotine strength.

Which Vape Products Will Be Taxed?

The duty covers liquid with or without nicotine, including nic salts, freebase liquid, nicotine shots, shortfills and liquid inside prefilled pods.

Empty kits, pods and Replacement Coils are outside the duty. In a prefilled kit, the liquid is liable, but the device is not.

Will E-Liquid Prices Rise by £2.64 per 10ml?

In the Reddit post below, a user says their supplier warned of a £2.64 rise per 10ml and asks where others plan to shop.

The £2.64 figure assumes the full duty plus VAT is passed on. That could happen, but the law does not set shelf prices.

HMRC confirms the rate in its Vaping Products Duty Guidance, but not a fixed retail increase.

When Do Duty Stamps Become Compulsory?

New liable stock released from 1 October must carry a duty stamp. Older stock gets a six-month grace period.

What Changes on 29 October 2026?

The October measures extend age restrictions and tighten how these products may be supplied.

Wider 18+ Sales Rules

Nicotine vapes are already restricted to adults. From 29 October, the rule will also cover zero-nicotine vapes and other consumer nicotine products, including nicotine pouches. Scotland already restricts non-nicotine vape sales to adults.

Free Samples, Proxy Purchases and Vending Machines

Free distribution and vending-machine sales will also be banned. Buying a vape or nicotine product for somebody under 18 will become an offence.

For adults, age verification will remain a normal part of buying online or in-store.

What Changes in 2027?

Two more changes are scheduled for 2027, covering tobacco sales and vape advertising.

The Generational Tobacco Ban

From 1 January 2027, tobacco cannot be sold to anyone born on or after 1 January 2009. The fixed birth date makes the legal tobacco-buying age rise over time.

This rule applies to tobacco, not vapes. Legal vaping products will remain available to customers aged 18 and over.

The Vape Advertising Ban

The wider advertising and sponsorship ban is intended to begin on 1 June 2027, covering areas such as posters, paid online promotion, shop windows and sponsorship.

Restrictions already cover television, radio, print and much online advertising. Retail sites should still be able to provide factual sales information. See the Department of Health and Social Care Timetable.

Are Vape Flavours and Colourful Packaging Being Banned?

No new flavour or packaging restrictions are in force. The current proposals remain under consultation.

What the Government Is Consulting On

No new flavour ban is in force. A UK-wide consultation closes at 11:59 pm on 2 October 2026. Proposals include:

• Plain white packaging with limited branding

• Simpler flavour names using one recognised lead flavour

• Restrictions on names linked to sweets, desserts, alcohol or abstract concepts

• White, black or grey devices with no cosmetic lights

• Tighter rules on how vaping and nicotine products are displayed in shops

What Has Actually Become Law?

None has taken effect. The consultation does not immediately ban flavour ingredients. Compliant fruit, menthol, drink and dessert products remain legal.

What Do the New Vape Laws Mean for Adult Vapers?

The first noticeable change is likely to be price. Duty follows liquid volume, not nicotine strength or format. Empty hardware is unaffected, while bottled e-liquid and liquid in prefilled products are covered.

Compare the final price and liquid volume. Check that reusable devices have separate refills and replacement coils or pods. From April 2027, look for a duty stamp.

Flavour, packaging and display restrictions remain proposals. There is no UK flavour ban.
